Civil Litigation

Zuckerman Spaeder LLP's Civil Litigation Practice represents businesses and individuals whose disputes have led to litigation in federal or state courts, to arbitration before the American Arbitration Association or other groups, or to mediations sponsored by retired judges or other neutral parties. Because we are familiar with how businesses operate and have extensive experience in litigation, we are skilled at developing strategies for resolving business problems, whether in the courtroom or the conference room. Familiarity with the intricacies of court rules and discovery techniques, knowledge of the efficiencies that can be gained from technology, and sensitivity to the costs of the process enable us to represent our clients in an effective manner.

Our Civil Litigation Practice has first-hand experience with the intricacies of accounting principles, finance, and complex transactions, so that we have a head-start in understanding the client's problems, whether those of the company or the individual. We have represented defendants in disputes with government regulators; parties in antitrust matters, plaintiffs in class-action litigation, and individuals and companies in "whistle-blower" claims. We are equally at home in a myriad of contract, partnership, and financial controversies. When businesses face the prospect of bankruptcy, our substantial experience representing commercial debtors, creditors' committees, and litigation trusts assists us in attempting to maximize the value of the bankruptcy estate, and our familiarity with the workings of the bankruptcy court provides us with the tools to resolve problems in that forum as well.

We are equally experienced representing individuals with substantial financial concerns, particularly where contested estates or trusts are manifest. The individual who experiences this type of difficulty has needs similar to that of the business person, but also encounters personal relationship issues that we are used to accommodating in the process.

We practice in the federal and state courts where our offices are located, but we are also comfortable working with local counsel to bring or defend actions in other jurisdictions. Moreover, we are not restricted to the traditional courthouse environment: we also have extensive experience with the arbitration rules and practice applied to commercial and construction disputes, as this milieu often provides a superior, cost-effective forum for resolving controversies.
