Pension and ERISA Litigation
These are some of our recent cases in this area:
- We served as plaintiffs' counsel in a case resulting in one of the largest ERISA judgments ever in the 4th Circuit — close to $3 million — after a 7 1/2-year battle with the pension plan. The plaintiffs won enforcement of a highly favorable pension plan amendment, defeating claims that the amendment was the product of a federal labor racketeering conspiracy.
- We successfully negotiated a $19 million class action settlement in federal court litigation in Memphis, Tennessee on behalf of 2,500 pension plans. The complaint alleged that after the plans entrusted their pension plans to First Mercantile Trust Company and its affiliated entities, they were victimized by a fraudulent fee overcharge scheme. First Mercantile Trust and its affiliated entities are subsidiaries of one of the largest bank holding companies in Memphis.
