The NFL Settlement: What's the Deal?

In his Huffington Post article—“The NFL Settlement—What's the Deal?”—Zuckerman Spaeder LLP partner Dwight P. Bostwick discusses the National Football League’s (NFL) proposed settlement of concussion litigation brought by former players. Mr. Bostwick, who represents players in the case, questions whether the settlement fairly and fully addresses the needs of injured players. Mr. Bostwick expresses concern that the $700 million settlement fund could be expended before some players even develop symptoms, and he says qualifications for coverage are restrictive and unlikely to cover all the ways in which concussions affect the brain. At the same time, Mr. Bostwick says the NFL’s commitment to devote only $10 million to safety and awareness campaigns is insufficient, especially when compared with the $4 million cost for a 30-second Super Bowl commercial. While expressing an appreciation for the sport, Mr. Bostwick questions whether the players “who built the game” are getting what they deserve.
