Civil Litigation
White Collar & Investigations

Success in appellate litigation requires a combination of tenacity, originality, sophisticated legal analysis, and the ability to view a record with fresh ideas and perspective while drawing on insights formed through years of hard-fought experience. Effective appellate litigation also requires clarity and persuasiveness in both written and oral advocacy. While the underlying issues may be complex, the best appellate arguments cut through the complexity with succinct and powerful themes that drive the result. Our appellate attorneys bring these skills to each appeal that the firm handles.

Zuckerman Spaeder LLP has a seasoned and respected team of appellate litigators who have appeared in federal and state courts throughout the country, including the U.S. Supreme Court, U.S. Courts of Appeals, and the highest and intermediate appellate courts of many states. In particular, we have a wealth of experience before the federal and state appellate courts in New York, Maryland, and the District of Columbia. We have successfully litigated appeals arising at all stages of cases, from pre-trial rulings through post-trial matters, in both criminal and civil cases. We also have filed briefs on behalf of amicus curiaein the U.S. Supreme Court and federal and state appellate courts.

The depth or our appellate practice draws from our lawyers’ experience in the public sector. We count among our appellate practitioners lawyers who have supervised or argued appeals for the U.S. Department of Justice, the U.S. military, the District of Columbia Public Defender Service, and other public entities. Additionally, our appellate lawyers have served as law clerks on the U.S. Supreme Court, U.S. Courts of Appeals, and state supreme courts.

The firm has committed significant resources to pro bono appellate advocacy, most notably through our work with the Barbara McDowell Appellate Advocacy Project, a partnership with the Legal Aid Society of the District of Columbia. Co-founded by one of our attorneys, the project provides appellate representation to indigent civil litigants principally in family, housing, consumer, and public benefit cases; each year we evaluate dozens of potential appeals, co-write opening and reply briefs in selected cases, and participate in moot courts for oral argument in those appeals. For such work one of the firm’s appellate attorneys received the American Bar Association’s Pro Bono Publico Award.

Experience Highlights

Zuckerman Spaeder’s appellate lawyers understand that for our civil litigation clients, appellate advocacy must advance not only our clients’ legal positions, but also their business and commercial interests. Our lawyers, therefore, identify arguments for appeal in civil cases that seek to advance not only our clients’ legal positions, but their business and commercial interests as well.

Zuckerman Spaeder’s lawyers understand that effective appellate advocacy in a criminal matter begins with a meticulous review of the record, as it is often the subtle issues that can make for powerful grounds for appeal. Our lawyers develop and craft the arguments that both judgment and experience suggest are most likely to resonate with an appellate panel. Mindful that a successful appeal may result in further proceedings before the tribunal whose rulings gave rise to the appeal, our attorneys frame arguments to optimize our client’s position upon remand.
