Regulatory & Compliance

Businesses across a range of industries increasingly face stringent government regulation and aggressive enforcement. In this ever more complicated regulatory environment, companies and their employees must be vigilant to act in accordance with regulations and respond quickly and appropriately to correct oversights. Zuckerman Spaeder LLP attorneys understand these complex environments and work with clients to identify and mitigate the risks of potential enforcement actions, heading off compliance problems whenever possible.

Our attorneys have specific expertise in a number of areas in which they help clients meet regulatory and compliance obligations, including professional ethics, food and drug law, Foreign Corrupt Practices Act (FCPA), tax compliance, and health care. We have experience working with regulatory agencies such as the U.S. Department of Justice, Food and Drug Administration (FDA), Internal Revenue Service (IRS), Securities and Exchange Commission (SEC), and Department of Health and Human Services (HHS), in addition to state and local regulatory bodies, including state bar authorities. We also understand how to work with regulators and how to craft successful resolutions of controversies.

With the ever-present threat of enforcement, many businesses are evaluating their processes to prevent violations that could lead to costly civil and criminal enforcement actions. To this end, Zuckerman Spaeder conducts internal investigations in addition to providing expert business counseling and guidance. We have assisted companies, working closely with general counsels, in developing compliance programs and in training executives and other employees regarding their responsibilities. We have also drafted contracts for international businesses and lawyers to ensure their compliance with U.S. laws and have handled suspension and debarment proceedings arising from regulatory violations.

Our attorneys also represent clients when they have interests in pending or potential legislation before Congress, or policy issues before federal agencies. Our attorneys bring to this work their experiences serving on Capitol Hill and in the executive branches of federal or state governments. We help clients develop and implement legislative strategies, prepare congressional testimony (sometimes delivering that testimony on their behalf), and draft proposed legislation.
