Zuckerman Spaeder LLP, Jones Day, Markus Moss, and Bartlit Beck won a directed verdict on behalf of their respective clients in a case brought by more than a dozen Florida hospitals seeking billions of dollars in damages under the state’s RICO statute.
This win followed 50+ days of trial, which resulted in a deadlocked jury and ended with a mistrial. Following the trial, the defense filed a motion for a directed verdict. Zuckerman Spaeder partner Eric Delinsky delivered the oral argument on behalf of the defense.
In an order dated May 26, the court held that no reasonable jury could find direct proximate cause by clear and convincing evidence on the full trial record. The ruling eliminates the need for a new trial and stands to deter future RICO claims in similar contexts.
